1. Acceptance of Terms
By accessing eastlatax.com (the “Site”) or using any service offered by East LA Tax (“we,” “our,” or “us”), you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, please do not use the Site or our services.
2. Services Provided
East LA Tax provides individual and small-business tax preparation, ITIN application assistance, bookkeeping, prior-year filings, and related advisory services. We are an independent tax preparation business and are not affiliated with, endorsed by, or acting on behalf of the Internal Revenue Service (IRS), the California Franchise Tax Board (FTB), or any other government agency.
3. Client Engagement
A client engagement is established only after we have reviewed the information you submit, accepted you as a client in writing or by electronic confirmation, and you have agreed to any applicable engagement letter or fee quote. Submitting an intake form or uploading documents does not, by itself, create an engagement, an attorney-client relationship, or a fiduciary duty.
4. Client Responsibilities
You are responsible for providing complete, accurate, and timely information. We rely on the information and documents you provide and do not audit, verify, or independently investigate them unless specifically engaged to do so. You are responsible for retaining your own records, signing your return, and timely filing.
5. Fees & Payment
Fees are based on the complexity of the work and quoted before the engagement begins. Payment is due at the time services are rendered unless other arrangements are agreed to in writing. Past-due balances may incur reasonable late fees and may delay filing or release of your prepared return.
6. Acceptable Use of the Website
You agree not to misuse the Site, including by attempting unauthorized access, transmitting malicious code, scraping content, interfering with operation, or impersonating others. You must be at least 18 years old, or have the consent of a parent or legal guardian, to submit information through this Site.
7. Intellectual Property
All content on this Site — including text, graphics, logos, and software — is owned by East LA Tax or its licensors and is protected by U.S. and international intellectual-property laws. You may view and print pages for your personal, non-commercial use; any other use requires our prior written permission.
8. Disclaimer & Limitation of Liability
The Site and its content are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Information on the Site is general in nature and is not a substitute for professional tax, legal, or financial advice tailored to your specific situation.
To the fullest extent permitted by law, East LA Tax, its owners, employees, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Site or our services. Our total cumulative liability for any claim relating to a tax-preparation engagement shall not exceed the fees actually paid to us for that engagement.
9. Indemnification
You agree to defend, indemnify, and hold harmless East LA Tax from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your misuse of the Site, your violation of these Terms, or information you provide that is inaccurate, incomplete, or unlawful.
10. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. The exclusive venue for any action that may proceed in court is Los Angeles County, California.
11. Dispute Resolution
The parties shall first attempt to resolve any dispute informally by contacting us at the address below. If a dispute cannot be resolved informally within thirty (30) days, the parties may pursue binding arbitration administered under the rules of a recognized arbitration body in Los Angeles County, California, except that either party may pursue claims in small-claims court when eligible.
12. Changes to These Terms
We may update these Terms from time to time. The “Effective Date” above shows when the latest revision was published. Continued use of the Site after a change constitutes acceptance of the revised Terms.
